Conditions of Agreement This cat/kitten is being sold as a Pet. Seller guarantees that said cat/kitten is in good health. Said cat/kitten will Be checked by my vet and will have health certificate and TICA registration papers. It is highly recommended that the buyer brings said cat/kitten for a check-up with Buyers own vet within 72 hours. If any illness is found, during this 72 hour period, and is so documented in writing by a board-certified veterinarian, the cat/kitten can be returned to seller and seller will then replace said kitten with a kitten of comparable quality when it comes available. No monetary refund will be given. Seller must be notified within 24 hours of the examination by a veterinarian. Seller is not responsible for any vet bills incurred with the buyers vet. Seller will only cover vet costs at her own vet. The cat/kitten is guaranteed against fatal genetic diseases. If any inherent genetic disease is documented within the first 2 years of life, it must be documented by a board-certified vet in writing. The cat/kitten will be replaced by the seller with a healthy cat/kitten of the same quality when it comes available. No monetary refund will be given. If this cat/kitten dies within the first 2 years of life due to a lethal genetic or congenital defect, said cat/kitten will be replaced with a cat/kitten of equal value, when it comes available. The buyer must provide a signed written necropsy report from a licensed veterinarian to the seller. No monetary refund will be given. Buyer agrees to give this cat/kitten a good and loving home. Said cat/kitten will be kept up on all vaccinations and buyer will make sure that all medical attention and treatment is given if necessary. If the buyer fails to properly feed and care for said cat/kitten the seller reserves the right to take the cat/kitten back. No monetary refunds will be given should the need arise and the above make it necessary for the seller to confiscate the cat/kitten. Said cat/kitten cannot be resold, leased or traded as a breeder. Under no circumstance will this cat/kitten be sold, leased or given away to any pet shop, research laboratory or any similar facility. Buyer accepts the responsibility of caring for this cat/kitten including providing food, shelter, ample space, clean environment, medical attention, exercise and affection that any pet should receive. It is recommended that the cat ( especially kitten ) be kept indoors or have the proper enclosed area if to be outdoors or on a leash for his/her safety. If at any time said cat/kitten is found to be neglected and/or mistreated, the seller reserves the legal right to remove the cat/kitten from the premises and the buyer will surrender said cat/kitten and appropriate papers to seller unconditionally and without compensation or refund. Specific arrangements for pick up or shipping will be determined in advanced and confirmed to Buyer by Seller, with the cat/kitten's best interest and welfare in mind. This signed agreement must be returned prior to cat/kitten going home. There will be NO monetary refunds of deposits, purchase price, shipping costs, veterinary expenses, or any other costs incurred. The Buyer assumes responsibility of all costs/expenses in relation to cat/kitten after said cat/kitten leaves the possession of Seller, as well as any expense incurred at the request of the Buyer before the cat/kitten leaves the possession of the Seller. Sheba's Bengals does not guarantee against allergies associated with this cat/kitten, if the cat/kitten is returned to the seller, Buyer agrees to pay all expenses, including shipping costs. Since we have rejected other offers in order to reserve this cat/kitten for you. There are NO refunds if you choose to return this cat/kitten or refuse to take said cat/kitten. This cat/kitten will receive loads of tender loving care, will be fed the best possible diet, be given substantial amounts of entertainment and utmost care. Thank you for providing a wonderful home for you new family member. We look forward to pictures and updates with your beautiful baby. Buyer agrees to spay/neuter this cat/kitten between the ages of 4-6 months. Five months is recommended. Buyer agrees and guarantees that this cat/kitten WILL NOT be used for breeding. The buyer further agrees that if said cat is found to be used for breeding, the buyer must pay an additional $1,500 in damages to the breeder ( seller ) and any offspring that may result are to be delivered to the breeder ( Seller ) as the breeder's sole property. Also, the seller has the right to reclaim the said cat/kitten unconditionally with NO refund or replacement owed to Buyer. Any legal fees incurred will be paid by the Buyer. Buyer agrees that should Buyer no longer be able to keep this cat/kitten, the Seller will be allowed to help with the placement / re-homing of cat/kitten. Seller must approve any new placement with any new owner other than the Seller, Elisha LePage. There will be NO monetary refunds. The purpose of this contract is to protect all parties concerned. This contract is legally binding and applies only to the Buyer and Seller in this transaction and is non-transferable to other parties. Your signature below acknowledges you as the Buyer and indicates that you understand and are in full agreement to all the terms in this contract. Any legal fees incurred in upholding this contract will be paid by the buyer.
